BRIEF DESCRIPTION OF CLASS
Associate Attorneys (Insurance Industry Investigations) handle difficult legal issues requiring advanced skills and knowledge in the analysis, interpretation, and enforcement of the Insurance Law. They provide legal counsel in connection with investigation, enforcement, and prosecution of improper practices by insurance companies; and assist in developing the departments legislative and regulatory initiatives related to enforcement investigations.
These positions exist only at the Department of Financial Services.
DISTINGUISHING CHARACTERISTICS
ASSOCIATE ATTORNEY (INSURANCE INDUSTRY INVESTIGATIONS): non-competitive; render professional legal services in the investigations and enforcement of the Insurance Law and regulations in connection with department investigations.
RELATED CLASSES
Associate Attorneys supervise a group of attorneys responsible for providing legal advice and assistance to agency administrators and personally handle cases and issues that are novel, potentially precedent setting, or involve large sums of money.
Attorneys (Insurance) render legal services on matters of a high degree of difficulty involving Insurance Law and insurance companies. Incumbents analyze and review facts; render opinions involving the application of state and federal statutes, regulations, and case law on insurance related issues; present written or oral statements regarding cases; prepare pleadings and affidavits; and represent the department in court and/or non-disciplinary administrative proceedings.
ILLUSTRATIVE DUTIES
Assist in providing legal counsel in connection with the departments investigations and enforcement of improper practices in the insurance industry; research legal sources to determine interpretations of the law; issue recommendations on issues of potential inquiries or investigations; draft investigative documents such as subpoenas and interrogatories for service on industry, and review documents responsive to such investigative documents; meet regularly with Counsel to discuss sensitive and confidential matters relating to enforcement investigations; formulate department responses and strategies for remediation in enforcement investigations; coordinate investigations, enforcement, and prosecution activities with other federal and state agencies and assist in the departments involvement with those activities; research applicable legislation and regulations and draft proposed legislation and regulations in connection with enforcement and investigations; coordinate legislative, regulatory, and other initiatives relating to enforcement and investigations with the National Association of Insurance Commissioners, and, as appropriate, other state and federal agencies; participate in meetings with agency officials and outside parties; and perform special projects and studies related to corporate practices and fraud investigations among other areas as needed.
MINIMUM QUALIFICATIONS
Admission to the New York State Bar and five years of post-bar legal experience, including one year of litigation or financial industry investigations experience.
