Classification Standard  

 

 BRIEF DESCRIPTION OF CLASS SERIES

 

          Beverage Control Investigators investigate violations of the Alcohol Beverage Control (ABC) law, rules and regulations relating to the manufacturing, wholesale, retail, transportation, storage, and other aspects of the alcoholic beverage industry; and educate licensees and interested parties on the ABC law to promote compliance.

 

          These positions, which are peace officers, are classified at the Division of Alcoholic Beverage Control.

 

DISTINGUISHING CHARACTERISTICS

 

BEVERAGE CONTROL INVESTIGATOR:  full performance level; independently perform the full range of investigative activities.

 

SENIOR BEVERAGE CONTROL INVESTIGATOR:  first supervisory level; oversee field investigations conducted by Beverage Control Investigators.

 

SUPERVISING BEVERAGE CONTROL INVESTIGATOR:  second supervisory level; direct the enforement program in a zone office.
 

ILLUSTRATIVE DUTIES

 

BEVERAGE CONTROL INVESTIGATOR

 

·                 Conduct investigations to obtain information concerning non-compliance with the ABC law, rules or regulations by licensees or unlicensed operators.

 

·                 Examine records of licensed establishments, analyzing inventory, pricing and receipt data to ascertain compliance with disclosure and other requirements.

 

·                 Train police jurisdictions, licensees, establishment employees, trade associations and other community entities on the ABC law.

 

·                 Assist licensees to understand their legal responsibilities of selling or delivering alcohol; and provide training to help them fulfill their responsibilities.

 

·                 Interview complainants, witnesses, licensees, employees and take written statements/affidavits relating to possible violations of the ABC law, rules and regulations. 

 

·                 Conduct both disclosed and undercover investigations.

 

·                 Assist federal, State and local law enforcement agencies in investigation and inspections of premises where alcoholic beverages are sold, delivered, served and/or consumed.

 

·                 Attend meetings of law enforcement task forces, neighborhood groups, college coalitions, citizen organizations or other similar partnerships or associations.

 

·                 Serve orders of revocations, cancellations or suspensions of licenses and other directives from the Members of the State Liquor Authority.

 

·                 Prepare and submit written reports, memorandums or other documents relating to assigned investigations.

 

·                 Testify at administrative or court proceedings concerning investigations conducted.

 

·                 May provide security at Full Board meetings.

 

SENIOR BEVERAGE CONTROL INVESTIGATOR

 

·               Perform all the duties of Beverage Control Investigators.

 

·               Supervise and train subordinate investigators. Provide assistance on difficult cases.

 

·               Plan and oversee field investigations; and coordinate investigations with local law enforcement officials.

 

·               Confer with other staff regarding development of disciplinary actions and ensure that adequate evidence is obtained to substantiate violations.

 

·               Review complaints and police reports to determine the need for investigations.

 

·               Conduct confidential investigations in connection with complaints and alleged misconduct by subordinate ABC staff.

 

·               Enlist cooperation of local law enforcement officials where complaints indicate need for emphasis of enforcement of law.

 

·               Prepare various activities reports.

 

·               Assist in the efficient and effective operation of the enforcement program in a zone office.

 

 

SUPERVISING BEVERAGE CONTROL INVESTIGATOR

 

·               Oversee the enforcement program in a geographic zone with responsibility for the intake, review, completion and processing of all complaints relating to violation of the ABC law, rules or regulations.

 

·               Supervise Senior Beverage Control Investigators and clerical staff.

 

·               Review complaints and determine if there is sufficient cause to open an investigation. Determine the appropriate disposition of cases.

 

·               Coordinate joint investigations with other law enforcement agencies.

 

·               Plan and schedule training for police jurisdictions, licensees, establishment employees, trades associations and other community entities conducted by staff on ABC law.

·               Review training materials and recommends changes to training syllabus and modules to remain consistent with changes to ABC law.

 

·               Review completed investigation for completeness and quality. Confer with legal office on investigations as necessary.

 

·               Follow up on investigations; provide technical assistance and advice to subordinates on the most difficult cases.

 

·               Maintain control of investigations received, assignments made, cases pending and completed; and prepare operating reports.

 

·               Maintain liaison with other units in the agency to coordinate enforcement activities.

 

·               Represent the agency at various events to explain the enforcement program and promote compliance with the ABC law.   

 

·               Prepare various reports for executive management.

 

 

MINIMUM QUALIFICATIONS

 

 

BEVERAGE CONTROL INVESTIGATOR 

 

Open Competitive:  four years of field investigation or field auditing experience, which entailed preparing detailed narrative reports.

 

          SENIOR BEVERAGE CONTROL INVESTIGATOR

 

Promotion:  one year of service as a Beverage Control Investigator.

         

          SUPERVISING BEVERAGE CONTROL INVESTIGATOR

 

Promotion:  one year of service as a Senior Beverage Control Investigator.
