Classification Specification

 

BRIEF DESCRIPTION OF CLASS SERIES

This series applies principles and techniques of investigation to conduct or supervise the conduct of field investigations thato secure information used to take civil and criminal action against willful violators of the Unemployment Insurance Law. This series is classified only in the Department of Labor’s Office of the Inspector General.

DISTINGUISHING CHARACTERISTICS

UNEMPLOYMENT INSURANCE INVESTIGATOR: journey level; investigates and analyzes cases of alleged fraud or collusion by claimants or employers as well asand the more complex cases involving self-employing entities; interviews and makes determinations on attempts to violate Unemployment Insurance Law; requires. eExtensive travel is required.

SENIOR UNEMPLOYMENT INSURANCE INVESTIGATOR: first supervisory level; when assigned to a field office serves as the highest ranking investigator in offices with two to four Unemployment Insurance Investigators; directs field investigations in cases of suspected fraud or other violations of the Unemployment Insurance Law; trains subordinate staff in investigative techniques and keeps them informed of changes affecting the Unemployment Insurance Law;. when assigned to a field office, serves as the highest ranking investigator in offices with two to six Unemployment Insurance Investigators.

ASSOCIATE UNEMPLOYMENT INSURANCE INVESTIGATOR: supervises the unemployment insurance investigations of a large regional area and/or supervises unemployment insurance mass audits, determinations, and prosecution activities; conducts formal training; and clarifies policy directives for subordinates; in addition to handlingand handles more complex cases.

ASSISTANT DIRECTOR, LABOR SPECIAL INVESTIGATIONS: two-position class; assists the Director, Investigations by supervising and coordinating activities in either an upstate or downstate office.

The classes cited below include investigators whose work is significantly concerned with entitlement fraud.

Compensation Investigators in the Workers’ Compensation Board are engaged in all investigative aspects of no-insurance workers’ compensation and disability benefits claims. They investigate cancellation of insurance policies and initiate the prosecution of employers who fail to have proper coverage.

Compensation Claims Investigators in the State Insurance Fund investigate workers’ compensation and disability benefits claims and verify the continued eligibility of claimants.

Insurance Fraud Investigators in the State Insurance Fund conduct investigations of alleged insurance fraud and provide technical assistance to other agencies.; They conduct surveillance, interview witnesses, and collect evidence in support of their cases.

Social Services Medicaid Investigators conduct investigations of allegations against Medicaid providers.; They investigate cases, gather evidence in support of their cases, and document findings.

ILLUSTRATIVE DUTIES

UNEMPLOYMENT INSURANCE INVESTIGATOR: under the general supervision of a Senior Unemployment Investigator, analyzes, investigates, and makes determinations on cases of fraud, collusion, conspiracy, and other matters involving violations of the Unemployment Insurance Law by employers, including self-employing entities and claimants; reviews complaints received regarding possible fraudulent receipt of unemployment insurance benefits; conducts field investigations to gather pertinent information and evidence; locates, interviews, and obtains written statements, depositions, and affidavits from appropriate parties; examines relevant records to determine status of claimants and/or their eligibility for unemployment insurance; applies pertinent laws, rules, and regulations, and precedent decisions to facts established; makes determinations from investigative findings and prepares written narrative reports; testifies at hearings; and works with law enforcement agencies in prosecuting violators.

SENIOR UNEMPLOYMENT INSURANCE INVESTIGATOR: under the general direction of an Associate Unemployment Insurance Investigator, supervises a field unit or Central Office unit of the Unemployment Insurance Investigations Section; directs field investigations to uncover, deter, and fully investigate unemployment insurance fraud involving claimants, employers, Department employees, and the general public; directs the examination of employer books, records, and other documents to establish facts; oversees the interviewing of claimants, employers, and witnesses to ensure conformity to established investigative standards and procedures; reviews field investigators’ progress reports and initial determinations to ensure investigations are based on law and precedent; reviews, prioritizes and assigns computer post-audit and regular investigation cases; trains staff members in investigative techniques and procedures, the interpretation and application of Unemployment Insurance Law, and all relevant departmental policies; prepares statistical reports; prepares cases for prosecution; and may personally conduct field investigations in complex cases.

ASSOCIATE UNEMPLOYMENT INSURANCE INVESTIGATOR: under the general direction of an Assistant Director of Labor Special Investigations, supervises investigative activities in a large regional area or in the Central Office; may be responsible for the supervision of all field units and/or mass audit, prosecution and determination, and administration activities; reviews cases to assure proper and complete investigations and cases recommended for prosecution by investigation field units; manages computer post-audit cases; provides technical advice to subordinates in the preparation and investigation of cases involving complex issues; reviews operating and statistical reports to determine operational effectiveness; plans and coordinates the improvement of investigation processes, techniques, and procedures; conducts investigations of department employees; conducts formal training sessions as needed; directs, interprets, and clarifies the effect of new laws, policies, decisions, and procedures on investigative operations; reviews current Appeal Board and Court Decisions; and serves as liaison to other governmental agencies and the general public.

ASSISTANT DIRECTOR, LABOR SPECIAL INVESTIGATIONS: under the general supervision of the Director, Investigations, is responsible for the daily supervision and coordination of an upstate or downstate office; provides administrative assistance to the Director; maintains positive community relations; directs staff to assure that all policies and procedures are implemented; acts as a liaison, responsible for all personnel actions, with appropriate Divisions; prepares recommendations and reports in the areas of local office benefit controls, claimant and employer fraud cases, and, changes in internal procedures; reviews current and projected staffing needs and prepares budget requests for submission to the Director; personally conducts selected investigations personally in complex cases or at the request of the Director; recommends, conducts, and supervises training programs; cooperates with the Attorneys General, District Attorneys, and Federal Law Enforcement Agencies, and keeps Director informed of same; and, in the absence of the Director, directs all Unemployment Insurance Investigations Section activities.

MINIMUM QUALIFICATIONS

UNEMPLOYMENT INSURANCE INVESTIGATOR

Open Competitive:: I. Specialized Experience: one year of specialized experience in a field investigative position requiring the submission of detailed narrative reports. and AND II. General Experience: four years of business experience or experience in a public contact position;. cCollege credits maycan be substituted for up to four years of this general experience only., at the rate that 15 semester credit hours equal six months of experience.
