BRIEF DESCRIPTION OF CLASS

 

The Business Services Specialist 3 is responsible for the administration of the Business Enterprise Program, which provides and oversees small business enterprises for legally blind individuals of New York State.  The incumbent develops and implements policy to ensure compliance with the Federal Randolph Sheppard Act.

 

This is a single position class found only in the Office of Children and Family Services (OCFS)

 

CLASSIFICATION CRITERIA

 

This is a single position class characterized by responsibility for planning, administering and managing the Business Enterprise Program on a statewide basis.  This responsibility includes supervision over a Central Office staff in the conduct of legislative review and analysis, policy and program development, contract management and architectural design.  It also includes responsibility for three Regional Offices involved in supervision of legally blind individuals in the operation of small businesses.

 

This position is distinguished from the Business Services Specialist 2 by the scope of responsibility, extending to statewide administration of the program.

BASIC DUTIES AND ILLUSTRATIVE TASKS

 

Administers an extensive statewide small business enterprise program for eligible legally blind individuals under the Randolph Sheppard Act.

 

·        Develops, promulgates and implements policy and procedures to ensure consistency in the program with Federal and State guidelines.

 

·        Supervises the evaluation of new or revised legislation, regulations and policies to determine the effect of program operations.

 

·        Develops new initiatives for the Business Enterprise Program to pursue.

 

·        Supervises a statewide regional staff whose responsibility is the direct supervision of legally blind managers of small business enterprises.

 

·        Oversees and assists in the preparation of manuals and the development of program material for use by Business Enterprise Program staff and legally blind small business managers.

 

Administers Phase One of the Fair Hearing process.

 

Administers the Revenue Contract Section of the Business Enterprise Program to ensure expeditious implementation of the contracts.

 

Directs the financial oversight of the revenue contract income to ensure adherence to contract language and to guarantee revenue due to the Business Enterprise Program.

 

·        Works with staff of other divisions in OCFS to resolve problems and to develop corrective action.

 

·        Advises the Attorney General's Office of possible fraud and abuse and works with them to ensure compliance with the law.

 

Direct the activities of the Pension Plan for the legally blind managers of the small businesses.

 

·        Ensures prompt payment to the Retirement Plan and to insurance carriers.

 

·        Reviews and evaluates financial statements submitted by the insurance company and makes recommendations for the investment of the funds.

 

·        Coordinates benefit payments to retired members.

 

Directs the design and construction functions of the Business Enterprise Program which includes the structural and cosmetic maintenance of existing retail facilities and proposed new construction.

 

·        Approves payment of construction costs associated with design and construction.

·        Acts as liaison with Facilities Development Corporation and Office of General Services and other agencies involved in the design and construction process.

 

Represents Commission for the Blind and Visually Handicapped (CBVH) on committees and task forces concerned with the implementation and improvement of the Randolph Sheppard Act and related regulations.

 

INDEPENDENCE OF OPERATION

 

The Business Services Specialist 3 works under the direction of the Director, Bureau of Program Evaluation Support and Business Services who provides direction, guidance and review of program goals.  The incumbent utilizes a high degree of independent judgment and discretion in the administration of the statewide Business Enterprise Program.

 

COMPLEXITY

 

The high level of responsibility of the Business Services Specialist 3 is reflected in the statewide scope of planning, administrative and management duties assigned to the position.  More complex tasks include policy development and implementation, development of new program initiatives, resolution or problems related to revenue contract income and administration of Phase One of the Fair Hearing Process.  The least complex activities are overseeing and assisting in preparation of manuals and development of program material, and representation of CBVH on various committees and task forces.

 

COMMUNICATION

 

The incumbent in this title performs tasks that require frequent oral and written communications with management staff within the OCFS, other State agency administrators, subordinate staff, clients, Federal agencies, building managers/owners and others to gather and disseminate information on the operation of the Business Enterprise Program.  The communication involves discussion of program reviews, identification of problems and solutions, prioritizing problems and development and review of policies and procedures.

 

SUPERVISION EXERCISED

 

The incumbent supervises a staff of subordinate Business Services Specialists and personnel in accounting functions and the Food Services Management Program in developing and implementing procedures, scheduling and assigning work, setting priorities, providing technical assistance and training, and monitoring projects to ensure compliance with State and Federal rules and guidelines, plans and instructions from which they evaluate their work.
