Minimum Qualifications

On or before March 16, 2019, you must be a qualified employee of New York State and have had three months of permanent competitive or 55-b/55-c service as a:

For No. 38-201:

Either A. Human Resources Specialist 1, Human Resources Specialist Trainee 2, or Human Resources Specialist Trainee 1;

Or B. Administrative Specialist 1, or Head Clerk (Personnel).

For No. 38-202:

Either A. Human Resources Specialist 1, Human Resources Specialist Trainee 2, or Human Resources Specialist Trainee 1;

Or B. Legal Assistant 2.

For No. 38-203:

Either A. Human Resources Specialist 2 (Labor Relations);

Or B. Human Resources Specialist 2 or Administrative Officer 1.

Only the title or titles listed are qualifying.

If you were permanently appointed to a qualifying title on or before December 16, 2018, and have served continuously in this title since that date, you are eligible to file for this examination.

Qualifying Experience for Appointment from the Eligible List

After one year of the journey level service described in the Minimum Qualifications, successful candidates will be qualified for appointment from the eligible list.

Eligibles who meet the ?B? qualifications, and who are subsequently appointed to an ?A? title, may request to have their name added to the ?A? list, once they have completed the one year of service in the ?A? title. The request should be submitted in writing to the NYS Department of Civil Service, Albany, New York 12239; Attention: S1FNH.

The order of certification of this eligible list will be:

  2. Promotion Unit "All" eligibles
  3. Department "A" eligibles

Notes

  1. Background Investigation/Justice Center Review: In some agencies, the names of all prospective employees will be:
    • Checked against the Staff Exclusion List (SEL) maintained by the Justice Center for the Protection of People with Special Needs. Prospective employees whose names appear on the SEL as having been found responsible for serious or repeated acts of abuse or neglect will be barred from appointment and may have their names removed from the eligible list(s) for the title(s);
    • Investigated through a Criminal Background Check (CBC). All convictions must be reported. Conviction of a felony or misdemeanor or any falsified or omitted information may bar appointment or result in removal after appointment. Each case will be determined on its own merits, consistent with the applicable provisions of state and federal laws;

    and may be:

    • Screened against the Statewide Central Register of Child Abuse and Maltreatment (SCR). Prospective employees whose names appear on the SCR may be barred from appointment. (NY Social Services Law, Section 424a.)

    You will be responsible for payment of all required fees.

  2. Travel Requirements: For Exam No. 38-202 and No. 38-203, Appointment to certain positions requires extensive travel within a designated area of assignment. Appointees to these positions may be required to operate a motor vehicle or otherwise demonstrate their capacity to meet the transportation needs of the job. If the position requires that you operate a motor vehicle, you must possess a driver's license valid in New York State at the time of appointment and continuously thereafter. Field work and travel expenses are reimbursed on a fixed schedule.
  3. Salaries may vary based on negotiating unit.

Subject of Examination

There will be a written test which you must pass in order to be considered for appointment. The written test is designed to test for knowledge, skills, and/or abilities in such areas as: For Examination Numbers

1. Analyzing and evaluating information - These questions test for the ability to analyze, interpret, and draw reasonable conclusions from information presented in text, data, images or symbols. This may involve identifying a significant problem or issue; focusing on relevant data and text; identifying trends, relationships, and significant features; assessing relevant alternatives; suggesting or evaluating possible conclusions; and applying logical principles to information provided. 2. Fundamentals of agency personnel programs - These questions test for basic knowledge used in staffing, developing, and maintaining an adequate and competent work force. The questions will cover basic concepts related to position classification, employee benefits, legal requirements, and workforce management. X  
3. Fundamentals of agency labor relations programs - These questions test for basic knowledge used in managing and administering agency labor relations programs. The questions will cover basic concepts related to collective bargaining agreements, disciplinary programs, legal requirements, and staffing considerations.  XX
4. Preparing reports and official documents - These questions test for the ability to prepare reports and other official documents for use within and among governmental agencies, in legal or regulatory settings, or for dissemination to the public. Some questions test for a knowledge of grammar, usage, punctuation, and sentence structure. Others test for the ability to present information clearly and accurately, to use the proper tone, and to organize paragraphs logically and comprehensibly. XXX
5. Supervision - These questions test for knowledge of the principles and practices employed in planning, organizing, and controlling the activities of a work unit toward predetermined objectives. The concepts covered, usually in a situational question format, include such topics as assigning and reviewing work; evaluating performance; maintaining work standards; motivating and developing subordinates; implementing procedural change; increasing efficiency; and dealing with problems of absenteeism, morale, and discipline. If you pass, your seniority credit(s), if any, will be included in the computation of your final score. Rank on the eligible list will be determined after adding any wartime Veterans' credits to your final passing score.

Credit for Seniority

Seniority is credited at the rate of one credit for each five-year period (or fraction thereof), excluding the first year of service.

Duties

As a Human Resources Specialist 2, you would perform duties requiring a high level of competence in the human resources field and generally work under broad guidelines from a higher-level manager or Director Human Resources. They typically supervise and train entry-level professionals and administrative support staff. They assign work, give written and oral instructions and guidelines, are available for advice and to aid, and review periodic reports and completed work for conformance to established standards.

As a Human Resources Specialists 2 and 3 (Labor Relations), you would perform similar duties to plan, develop, or direct a labor relations program or a portion of it for an agency or a group of facilities. Illustrative duties include: direct the implementation of collective bargaining agreements; represent the agency in statewide and agency level negotiations, and direct or participate in labor management committees; provide expert advice and assistance to program managers and supervisors in disciplinary matters; review and evaluate changes in negotiated agreements, and advises management of their impact on the labor relations program; provide advice and consultation to supervisors and managers to ensure proper interpretation and administration of contract provisions and avoid misunderstandings that may lead to employee dissatisfaction and grievances; prepare witnesses for both direct and cross examination at disciplinary arbitration hearings, prepare and present opening statement outlining witness testimony, case evidence, and theory of the case; deliver closing argument summarizing major points of State?s case or draft written brief summarizing main arguments and presenting persuasive discussion of management?s case; liaison with legal office on issues involving employee relations activity, including litigation involving disciplinary action or grievance determinations, and Equal Employment Opportunity Commission and Division of Human Rights complaints; and supervise lower level professional and clerical staff involved in labor relations activities.

Admission to Examination

Notice to appear for the test may be conditional as review of applications may not be made until after the test. Taking State and Local Examinations Scheduled for the Same Day

If you have applied to take a written test announced by either one or several local jurisdictions (county, town, city) scheduled to be held on the same test date as this written test, you must notify each of the local jurisdictions no later than two weeks before the test date to make arrangements for taking all tests at one test site. All tests will be held at the state examination center. Eligibility for Examination

To be considered a qualified employee eligible to compete in this examination, you must be employed in, or on leave from, the specified department or agency on a permanent or contingent permanent basis in the competitive class, or in the non-competitive class or labor class if specifically noted on this announcement (or be on an appropriate preferred list), and have the specified time in the specified title or salary grade. You may not compete in a test for a title if you are permanently employed in that title (unless you are still on probation) or in a higher direct line of promotion.

Do not bring cell phones, beepers, headphones, or any electronic or other communication devices to the test site. The use of such devices at the test site in the test room, hallways, restrooms, building, grounds, or other areas could result in your disqualification.
