Please be advised that effective December 1, 2021 the New York State Department of Civil Service will have a mandatory COVID-19 vaccination/testing policy for in-person examinations administered at a New York State test center. For more information, you can access the full policy on the Department of Civil Service website.

Due to current testing space limitations, candidates may need to travel to one of the following test sites to take this examination: Albany, Buffalo, Nyack, Port Jefferson, Poughkeepsie, Syracuse, and an additional downstate location. Candidates will be notified of their test site location on their admission notice.

Appointees who work in the five boroughs of New York City or in Nassau, Suffolk, Rockland, or Westchester Counties will receive an additional $3,026 annual downstate adjustment. Appointees who work in Dutchess, Orange, or Putnam Counties will receive an additional $1,513 annual mid-Hudson adjustment.

Minimum Qualifications

On or before February 19, 2022, you must have:

For No. 26-785: an associate's degree (or higher) in a paralegal/legal assistant program OR a certificate in a paralegal/legal assistant program where either the degree or certificate was granted from a regionally accredited college or university, or college or university accredited by the Accrediting Council for Independent Colleges and Schools (ACICS) or one approved by the American Bar Association (ABA).

For No. 26-786:

Either 1: a bachelor's degree (or higher) in a paralegal/legal assistant program from a regionally accredited college or university, or college or university accredited by the Accrediting Council for Independent Colleges and Schools (ACICS) or one approved by the American Bar Association (ABA); AND one year of subsequent full-time experience as a Paralegal/Legal Assistant (see ?definition? below);

Or 2: an associate's degree (or higher) in a paralegal/legal assistant program OR a certificate in a paralegal/legal assistant program where either the degree or certificate was granted from a regionally accredited college or university accredited by the Accrediting Council for Independent Colleges and Schools (ACICS) or one approved by the American Bar Association (ABA) AND two years of subsequent full-time experience as a Paralegal/Legal Assistant (see ?definition? below).

If you expect to meet the educational requirements by September 30, 2022, you can be admitted to the written test, but you cannot be considered for appointment until you submit proof of successful completion of the educational requirement to the Appointing Authority at the time of the employment interview. Failure to meet the educational requirements by September 30, 2022 may result in your removal from the eligible list.

Definition: For the purposes of this examination, a Paralegal/Legal Assistant is someone who applies knowledge of the law and legal procedures in rendering direct assistance to lawyers, clients, and courts; prepares and interprets legal documents and forms; researches, compiles and uses information from legal materials to provide both written and verbal comments on their findings; and analyzes and handles routine procedural problems independently with minimal attorney oversight.

Substitution: Graduation from an accredited (ABA approved) law school with a degree required by New York State Bar admittance will be accepted as meeting the educational requirements for either examination.

Non-qualifying degrees: Non-qualifying degrees include but are not limited to degrees in Criminal Justice, Legal Studies, Liberal Arts, Political Science, Business Administration and Business Management.

Non-qualifying experience: Non-qualifying experience includes but is not limited to experience which is limited solely to general clerical or secretarial duties performed in a law office.

Important: Non-degree certificates of completion or diplomas awarded by a training institution or company not regionally accredited or accredited by the Accrediting Council for Independent Colleges and Schools (ACICS) or approved by the American Bar Association (ABA) are not qualifying.

Notes

  1. Your degree or college credit must have been awarded by a college or university accredited by a regional, national, or specialized agency recognized as an accrediting agency by the U.S. Department of Education/U.S. Secretary of Education. If your degree or college credit was awarded by an educational institution outside the United States and its territories, you must provide independent verification of equivalency. You can write to the Examination Information Desk of the NYS Department of Civil Service for a list of acceptable companies who provide this service. This information can also be found on the Internet at http://www.cs.ny.gov/jobseeker/degrees.cfm. You must pay the required evaluation fee. If you are applying on the Internet, you must mail the independent verification of equivalency to the New York State Department of Civil Service, Albany, New York 12239. Attention: S1-MME.
  2. A promotion examination is also being held for Legal Assistant 2. If you are eligible for appointment from a promotion list, you may not be appointed in your own agency from the list resulting from this examination open to the public.
  3. Although a promotion examination is being held for Legal Assistant 2, it is expected that appointments will be made as the result of these examinations open to the public.
  4. Additional vacancies are anticipated which may include Spanish language positions. The eligible list wil l be used to fill those positions, and eligibles must demonstrate proficiency in the Spanish language at a level that will ensure their ability to perform properly the duties of the positions. If other language parenthetics are established, the list will also be used to fill those positions and appointees must demonstrate their language proficiency prior to appointment.
  5. Travel Requirements: Appointment to certain positions requires extensive travel within a designated area of assignment. Appointees to these positions may be required to operate a motor vehicle or otherwise demonstrate their capacity to meet the transportation needs of the job, which may include travel to various places including correctional facilities and courthouses. If the position requires that you operate a motor vehicle, you must possess a driver's license valid in New York State at the time of appointment and continuously thereafter. Field work and travel expenses are reimbursed on a fixed schedule.
  6. Appropriate part-time and volunteer experience, which can be verified, will be accepted on a prorated basis.
  7. New York State residence is not required.

These positions exist in various agencies throughout New York State government and are primarily in Albany and New York City.

Duties

As a Legal Assistant 1, under the direction of staff attorneys in various areas of law, you would be responsible for compiling and organizing documentation; preparing and assisting in the preparation of legal documents and forms; ensuring court documents, including judgments, are properly and timely filed; logging information; and preparing correspondence and subpoenas. You would respond to inquiries and complaints, track cases, ensure that deadlines are met, and maintain various calendars. You would conduct research into legal matters, analyze materials, and present both verbal and written comments on your findings. You might prepare and maintain files, interview witnesses and clients, record and monitor the status of legislation, and gather and create materials and summaries of legislation and current legal developments pertinent to the agency. The use of computer software and the Internet is integral to these positions and may be used in any of the following areas: preparing documents, creating or updating databases or spreadsheets, tracking and researching assignments or litigation, and communicating. You might calculate monies owed to the State and determine responsible parties. This position requires the ability to work independently on some matters/assignments.

As a Legal Assistant 2, your duties would be similar to those of Legal Assistant 1 but would be distinguished by increased responsibility, greater freedom of judgment, and degree of expertise in interpreting the overall mission of the bureau and agency. You might take depositions and summarize trial transcripts, review discovery demands and serve or arrange service of subpoenas. As a Legal Assistant 2, you might supervise paraprofessional or clerical staff.

Subject of Examination

There will be a written test which you must pass in order to be considered for appointment. The written test is designed to test for knowledge, skills, and/or abilities in such areas as:

  1. Evaluating conclusions in light of known facts - These questions will consist of a set of facts and a conclusion. You must decide if the conclusion is proved by the facts, disproved by the facts or if the facts are not sufficient to prove or disprove the conclusion. The questions will not be specific to a particular field.
  2. Interviewing - These questions test for knowledge of the principles and practices employed in obtaining information from individuals through structured conversations. These questions require you to apply the principles, practices, and techniques of effective interviewing to hypothetical interviewing situations. Included are questions that present a problem arising from an interviewing situation, and you must choose the most appropriate course of action to take.
  3. Legal terminology, documents and forms - These questions test for the ability to recognize definitions of specific common legal terms or the term which fits a certain description. The questions are presented in various forms such as simple definitions, examples of terminology, and the use of this terminology within documents and forms related to the legal field.
  4. Preparing written material - These questions test for the ability to present information clearly and accurately, and to organize paragraphs logically and comprehensibly. For some questions, you will be given information in two or three sentences followed by four restatements of the information. You must then choose the best version. For other questions,you will be given paragraphs with their sentences out of order. You must then choose, from four suggestions, the best order for the sentences.

Your final score must be 70 or higher in order to pass. Your final score on the eligible list will be determined after adding any wartime Veterans' and Civil Service Law Section 85-a credits.

Note: The Department of Civil Service may administer tests either online or with paper booklets and answer sheets. Online tests may be administered using Remote Proctoring. Admission to the Test: If approved, you will receive an admission notice which will indicate your assigned test date and the way your test will be administered. Your test may be administered with paper and pencil, online at a state test site using a State-provided Chromebook, or online at home on your personal equipment using Remote Proctoring Software. You cannot request to change your scheduled day or request a specific type of test administration.

Applicants are required to have a Personal NY.gov account and keep their email address up to date. The Department of Civil Service and other state agencies will communicate with you through email correspondence. This may include the notification of your test arrangements, examination results, and canvassing you for interest in appointment. Candidates granted an exemption will be offered the opportunity to take the examination via Remote Proctoring - a secure, web-based test delivery method that uses professional test proctors and technology to monitor applicants using a web camera as they complete an examination.

Admission to Examination

Notice to appear for the test may be conditional as review of applications may not be made until after the test. Taking State and Local Examinations Scheduled for the Same Day

If you have applied to take a written test announced by either one or several local jurisdictions (county, town, city) scheduled to be held on the same test date as this written test, you must notify each of the local jurisdictions no later than two weeks before the test date to make arrangements for taking all tests at one test site. All tests will be held at the state examination center. Cell Phones or Electronic/Communication Devices at the Test Site

The use of cell phones, beepers, headphones, or any electronic or other communication devices at your personal testing site or in the test room, hallways, restrooms, building, grounds, or other areas, except as expressly authorized by the Department of Civil Service, could result in your disqualification.
