Classification Standard

 

BRIEF DESCRIPTION OF CLASS SERIES

 

Insurance Examiners audit the financial condition and treatment of policyholders of insurers licensed to do business in New York State and investigate complaints from policyholders and consumers against licensees to determine compliance with New York State Insurance Law, Rules and Regulations, and perform other regulatory duties to assist the Insurance Department in carrying out its regulatory responsibilities. Insurance Examiners are classified only in the Insurance Department.

 

RELATED CLASSES

 

Bank Examiners conduct field examinations and office analyses of State-chartered financial institutions to ensure that they conduct their businesses safely and soundly and that their policies and operations conform to the Banking Law and the Departments rules and regulations.

 

State Program Examiners apply a diverse set of skills, professional knowledge and training to perform and/or manage the financial and performance audits, reviews and evaluations of New York State and New York City agencies, public benefit corporations, and for profit and not-for-profit organizations that contract with State agencies. 

 

DISTINGUISHING CHARACTERISTICS

 

All positions are in the competitive jurisdictional class.

 

INSURANCE EXAMINER:  journey level for the series; under supervision, performs tasks that are part of larger assignments or resolves and/or processes routine regulatory matters.

           

SENIOR INSURANCE EXAMINER:  first supervisory level; may serve as Examiner-in-Charge of an examination, or may work independently on more complex cases or difficult insurance regulatory matters.

 

ASSOCIATE INSURANCE EXAMINER:  supervises a unit or section of a bureau or takes charge of an examination of the largest and most complex insurance companies, or has responsibility for a smaller examination or technical special studies unit or section.

 

PRINCIPAL INSURANCE EXAMINER:  functions as a section head or the assistant to a section head performing high level technical insurance regulatory work, either independently or in a supervisor capacity.

 

SUPERVISING INSURANCE EXAMINER: responsible for overall supervision of the activities of a section; may be responsible for a highly technical regulatory area with a small staff or have many subordinates and a broad range of responsibilities.

 

CHIEF INSURANCE EXAMINER 3:  assists a Chief Insurance Examiner 2 in administering programs and activities under a bureaus jurisdiction; is responsible for the overall supervision of staff and a bureaus day-to-day regulatory responsibilities.

 

CHIEF INSURANCE EXAMINER 2: assumes responsibilities for a substantial portion of the workload and resolves many of the problems that arise through the organization; coordinates activities among a bureaus units; assists in preparing legislation and has input into policy-making decisions.

 

CHIEF INSURANCE EXAMINER 1: oversees, plans and directs a bureaus activities; is responsible for setting policy for a bureau and achieving its overall objectives; advises the Superintendent on matters within the province of a bureau.

 

ILLUSTRATIVE DUTIES

 

INSURANCE EXAMINER:  reviews company transactions for compliance with the Insurance Law, Rules, Regulations and Circular Letters; reviews treatment of policyholders; verifies the annual statement for accuracy and completeness; reviews expenses incurred by the company; reviews operations including compensation for agents, training allowances, licensing, contracts, etc.; reviews underwriting practices; prepares written reports on findings; may discuss findings with company officials; assists in the valuation of assets and the compilation of liabilities; assists in forensic accounting reviews and examinations of alleged money-laundering activities; investigates violations of the Insurance Law, Rules and Regulations, and complaints involving the Departments licensees; assists in reviewing and analyzing insurance products and rates; and assists in conciliating disputed claims.

 

SENIOR INSURANCE EXAMINER:  verifies or oversees verification of all of a companys assets and liabilities; reviews companys conduct including treatment of policyholders; reviews submissions, transactions and filings including applications for acquiring additional lines of business; oversees mergers and consolidations of insurers for compliance with the Insurance Law, Rules, Regulations and Circular Letters; may be responsible for technical review and analysis of product regulation, underwriting, rating, marketing and claims practices; participates in conferences with company officers; may supervise a unit of subordinate examiners; resolves problems posed by subordinate examiners; reviews work papers, reports and findings of subordinate examiners; compiles, prepares, signs and submits the final report of a small to moderate sized examination; consults with bureau on early warning signs of company distress; assists in conducting financial projection tests; participates in forensic accounting reviews and examinations of alleged money-laundering activities; resolves affordability, availability and rating complaints and inquiries; and analyzes more complex and/or sensitive complaints and investigations.

 

ASSOCIATE INSURANCE EXAMINER:  devises methods and procedures for improving field examining techniques; reviews and evaluates the effectiveness and adequacy of procedures and makes recommendations to superiors; assists a bureau or section head in preparing material for hearings; conducts important conferences and corresponds with companies; supervises the examination and evaluation of company assets and security holdings and market conduct examinations; prepares final reports of examinations; assigns and reviews the work of subordinates; reviews the more complicated or significant transactions and agreements between insurers; conducts financial projection tests; conducts forensic accounting reviews and examinations of alleged money-laundering activities; conducts and/or oversees complex investigations and complaints against licensees; responsible for special projects; oversees the analysis and audit of insurers financial statements; develops new financial and statistical reporting forms; plans and conducts statistical inquiries; writes and reviews reports; and prepares and furnishes statistical data for Federal and State agencies.

 

PRINCIPAL INSURANCE EXAMINER:  makes on-site visits to ongoing field examinations to determine progress, provides supervision and resolves problems encountered by examiners-in-charge; reviews reports and recommendations; may conduct examinations of a highly complex nature or special investigations requiring a high degree of technical knowledge; advises examiners on unusual or complex examination or regulatory problems; reviews organization and financing of new insurance organizations; oversees analysis of annual and interim financial statements; supervises financial projection tests; supervises and/or conducts complex forensic accounting reviews and examinations of alleged money-laundering activities; conducts studies of information technology (IT) operations of insurance organizations and develops IT examination techniques; trains examiners in procedures and techniques of insurance regulation; confers with company officials; and may draft, prepare or review proposed legislation.

 

SUPERVISING INSURANCE EXAMINER: supervises and assigns examiners to conduct periodic and special examinations of insurers, forensic accounting and examinations of alleged money-laundering and/or fraudulent activities; reviews and analyzes examination reports and financial projection test findings; supervises examiners engaged in regulation of rates, rating plans, classification and policy forms; consults with supervisors and company officials on unique corporate problems, procedures, and statutory provisions; advises supervisors and counsels staff on proposed insurance regulations and legislation; participates in meetings with other agencies, industry representatives, other government officials and the public on insurance related issues; performs high level technical work involved in regulating relationships of licensed insurers with holding companies and subsidiaries; reviews proposed stock purchase plans of domestic stock insurers; reviews annual relicensing of foreign and alien insurers; reviews proposed changes in subscriber rates; supervises complaint handling and investigation of licensees; reviews Department reports and recommends appropriate action to Bureau Chief.

 

CHIEF INSURANCE EXAMINER 3:  assists a Chief Insurance Examiner 1 and/or Chief Insurance Examiner 2 in all facets of the administration of a bureau including regulation of the financial condition, rates, forms, availability of insurance products, financial examinations, investigations, complaints and market conduct activities; consults with the Chief Insurance Examiner 1 or 2 on the administration and long-range planning of a bureau; assists in preparing legislation, regulations and circular letters; establishes clear lines of authority and responsibility for all units; prepares speeches, opinions and decisions for the  Chief Insurance Examiner 1 and 2 and Executive Bureau; confers with insurance industry officials and the public; makes appropriate use of subordinates, associates, and fiscal and physical resources in achieving objectives.

 

CHIEF INSURANCE EXAMINER 2:  assumes responsibilities that can only be handled by an individual with higher level authority; absorbs many of the problems and makes policy decisions on matters that arise through the organization; provides input into policy-making decisions; may represent the Department in meetings with other agencies, industry representatives, the legislature, Governors office and the public; oversees operations of sections such as financial condition, corporate conduct, actuarial review, licensing, investigations, complaints product and rate regulation; assists the Chief Insurance Examiner 1 in preparing legislation; coordinates the activities among the units in a bureau; and supervises a Chief Insurance Examiner 3.

 

CHIEF INSURANCE EXAMINER 1:  implements and carries out the policy initiatives of the Departments administration; advises the Superintendent and Deputy Superintendents on all matters pertaining to areas within the bureaus responsibility; represents the Department in meetings with other agencies, industry representatives, the legislature, Governors office and the public; plans and directs examinations of insurance companies, exercises technical and administrative authority over a bureau in regulatory, administrative and personnel matters; oversees the licensing, testing and continuing education of agents, brokers and adjusters and investigations of the trustworthiness of the Departments licensees; oversees the consumer complaint and investigations programs; reviews policy recommendations from subordinates and establishes policy for his/her bureau; prepares the bureaus budget; represents the Department at administrative and public hearings; and oversees the development and implementation of a bureaus legislative program.

 

MINIMUM QUALIFICATIONS

 

INSURANCE EXAMINER

 

Promotion: Completion of a two-year traineeship as an Insurance Examiner Trainee.

 

Open Competitive: (1) Bachelors Degree and 24 credit hours in accounting/auditing or a Masters Degree in accounting, auditing, business administration, economics, finance, or taxation, and 12 credit hours in accounting/auditing AND (2) two years of experience in a professional position in claims, underwriting, ratemaking or accounting/auditing with an insurance company, or as a insurance adjuster, agent or broker, or as an auditor with a CPA firm with verifiable experience in auditing insurance companies, or in a professional regulatory position with a government insurance department or agency.
