Classification Standard

 

BRIEF DESCRIPTION OF CLASS SERIES

 

            Safety and Health Engineers review plans and make determinations on applications and variances dealing with various Department of Labor (DOL) rules and provide expert engineering consultation on safety and health matters. These positions are classified only at DOL. 

 

RELATED CLASSES

 

Safety and Health Inspectors perform inspection of selected public and private work sites and places of public assembly to identify unsafe conditions and work practices; ensure conformance with established occupational safety and health standards; provide training; and protect workers and the public.

 

DISTINGUISHING CHARACTERISTICS

 

            SENIOR SAFETY AND HEALTH ENGINEER: full performance level; review, and recommend action on plans and applications dealing with safety and health matters.

 

            ASSOCIATE SAFETY AND HEALTH ENGINEER: advanced performance level; handle the more difficult assignments; and may supervise Senior Safety and Health Engineers and support staff. 

 

ILLUSTRATIVE DUTIES

           

            SENIOR SAFETY AND HEALTH ENGINEER

 

Review and develop recommendations on applications seeking approval, variance from, and modification of mandated safety performance and specification standards.

 

·         Evaluate scope of problems and technical facts to determine whether a field investigation is warranted; develop specific questions and areas for further investigation.

·         Review investigation reports, existing conditions and petitioners variance proposals in light of applicable standards, general safety precedents and policies, rules or applicable laws to determine feasibility and propriety of approving the application. 

·         Prepare recommendations on petitions, providing advice on special problems, circumstances or ramifications; describe specific bases from an engineering standpoint leading to the final determination.

·         Provide technical assistance to applicants to assist them in complying with DOL rules.

 

Represent the Commissioner of Labor in judicial and quasi-judicial proceedings pertaining to the Labor Law, Uniform Fire Prevention and Building Code, Occupational Safety and Health Administration (OSHA) standards and Industrial Code Rules.

 

·         Prepare reports on hearings on appeal from determinations; and ensure proper citation of appropriate laws, rules or policies.

·         Maintain records of all approved and disapproved variances and modification of abatement petitions in the event of legal action, and for use as precedents; and research resources pertaining to standards.

 

Conduct consultant projects and building plan review for building and fire code compliance with safety standards.

 

·         Analyze research data, published reports, federal criteria and other information related to OSHA standards.

·         Review comments, suggestions or reports from various organizations and groups for revising existing standards and establishing new ones.

·         Draft new or revised State safety and health standards for consistency with federal criteria and technical soundness.

·         Participate at public hearings on revised or new standards.

·         Analyze applications for funding to the Hazard Abatement Board and recommend action on proposals.

 

ASSOCIATE SAFETY AND HEALTH ENGINEER

 

Perform all the duties of a Senior Safety and Health Engineer, and in addition, perform the more technically difficult review and evaluation of petitions for variance relating to engineering projects.

 

·         Write safety and health standards consistent with statutory authority and agency policy; review comments and suggestions from various organizations for new or revised standards.

·         Review investigations, accident reports, comments by other states and other agencies in a continuous process of analysis and evaluation of standards or hazards relating to building plans, use of devices and all engineering matters related to adequacy and appropriate of existing State engineering standards.

·         Review plans for construction or renovation of public and private buildings, including places of public assembly and ski tows.

 

Represent the Commissioner of Labor in judicial and quasi-judicial proceedings pertaining to the Labor Law, Uniform Fire Prevention and Building Code, OSHA standards and Industrial Code Rules.

 

·         Prepare and evaluate hearing reports and appeals.

·         Provide technical expertise.

·         Maintain and revise records relating to judicial and legal actions related to engineering projects.

 

Participate in public hearings related to safety and health engineering projects and propose new or revised standards for general applicability to construction and abatement projects.

 

Cooperate with the State Attorney Generals Office in the conduct of court actions requiring expert engineering advice.

 

Supervise staff by assigning and reviewing work.

 

MINIMUM QUALIFICATIONS

           

            SENIOR SAFETY AND HEALTH ENGINEER    

 

Open Competitive: three years of engineering experience and possession of either a:

 

  1. New York State  Professional Engineers (PE) license and current registration; or
  2. PE license equivalent to New Yorks and current registration from a state or territory of the United States.

 

           

            ASSOCIATE SAFETY AND HEALTH ENGINEER

 

Promotion:  one year of service as a Senior Safety and Health Engineer.
