Classification Standard

BRIEF DESCRIPTION OF CLASS SERIES

          Positions in this series oversee all medical issues including promoting quality care and outcomes for all injured workers, implementation and updating of the medical treatment guidelines and the education and training of the guidelines used at the Workers Compensation Board. These positions are in the non-competitive class.

DISTINGUISHING CHARACTERISTICS

WORKERS COMPENSATION ASSISTANT MEDICAL DIRECTOR: one-position class, managerial level; under the general direction of the Workers Compensation Medical Director oversees statewide medical guidelines training program for adjudicators, health care providers, and medical reviewers.

WORKERS COMPENSATION MEDICAL DIRECTOR:  one-positon class; managerial level; under the general direction of the Executive Director, provides expert advice and consultation to the Chair, executives, and Medical Directors Office on medical issues before the Board; issues and revises medical treatment guidelines; and writes medical opinions for disputed cases and controversial medical subjects; supervises Workers Compensation Assistant Medical Director.

RELATED CLASSES

Chair Psychology Practice Committee, Chairman Chiropractic Practice Committee, Chairman of Podiatry Practice Committee, Member Chiropractic Practice Committee, Member Podiatry Practice Committee, and Member Psychology Practice Committee are per diem licensed medical professionals at the Workers Compensation Board appointed by the Chair.  The positions investigate, hear, and make findings with respect to all charges as to professional or other misconduct of any authorized chiropractor, podiatrist, or psychologist under the rules and procedures to be prescribed by the Workers Compensation Boards Chair and shall report evidence of such misconduct, with their findings and recommendations.  Appointees to these titles are licensed and registered in podiatry, chiropractic, and psychology.

Assistant Directors Compensation Claims & Medical Administration and Director Compensation Claims & Medical Administration oversee the New York State Insurance Funds claims and medical administration functions performed in various business offices throughout the State.

Disability Review Physician Specialist and Supervising Disability Review Physician review and evaluate medical appropriateness of approval or disapproval of requests for disability payments under the Social Security law at the Office of Temporary and Disability Assistance.

ILLUSTRATIVE DUTIES

WORKERS COMPENSATION ASSISTANT MEDICAL DIRECTOR:  provide medical expertise to the Workers Compensation Board Chair and executive staff on health care programs, authorization of licensed physicians, chiropractors, podiatrists and psychologists, granting of licenses to medical bureaus, medical centers, laboratories and treatment of injured workers; personally write medical opinions in intricate and disputed cases referred to the Administrative Review Division; write medical opinions in complicated death cases; issue medical opinions on causal relationship, advisability of operations, diagnosis, schedule loss findings, necessity for further treatment and examination in the most complex cases; prepare written and oral reports on controversial medical subjects; develop and implement strategies and programs to ensure appropriate training for adjudicators, health care providers and medical reviewers who utilize the medical fee schedule and treatment guidelines; ensure that agency rules and regulations concerning the treatment guidelines, reporting requirements, billing procedures, dispute resolution and education certification requirements is consistent with educational content; work with Counsels Office and Office of Financial Services to prepare request for information/request for proposals to solicit vendors with experience in medical issues and treatment guidelines, and drug formulary to develop content of the medical elements of training curriculum; and establish relationships with organizations to deliver instruction on the medical aspects of the education which requires a high level of medical skill and knowledge. 

WORKERS COMPENSATION MEDICAL DIRECTOR: direct and oversee the development and updating of medical treatment guidelines, and drug formulary, and participate on the medical fee schedule committee; provide medical expertise to the Workers Compensation Board Chair and executive staff on health care programs, authorization of licensed physicians, chiropractors, podiatrists and psychologists, granting of licenses to medical bureaus, medical centers, laboratories and treatment of injured workers; personally write medical opinions in intricate and disputed cases that are appealed; write medical opinions in complicated death cases; issue medical opinions on causal relationship, advisability of operations, diagnosis, schedule loss findings, necessity for further treatment and examination in the most complex cases; prepare written and oral reports on controversial medical subjects; update and maintain medical treatment guidelines and education; and set long-term and short-term goals for staff, set priorities, ensure compliance with agency policies, rules and regulations, and perform the full range of supervisory duties.

MINIMUM QUALIFICATIONS

WORKERS COMPENSATION ASSISTANT MEDICAL DIRECTOR

Non-competitive: Possession of a degree as a Medical Doctor, or Bachelor of Medicine/Bachelor of Surgery and a license to practice medicine in New York State, completion of an approved internship and residence in surgery, or physical medicine and rehabilitation, and three years of post-training experience in an appropriate specialty.

WORKERS COMPENSATION MEDICAL DIRECTOR:

Non-competitive: Possession of a degree as a Medical Doctor, or Bachelor of Medicine/Bachelor of Surgery and a license to practice medicine in New York State, completion of an approved internship and residence in surgery, or physical medicine and rehabilitation, and five years of post-training experience in an appropriate specialty.
