Classification Standard

 

 

Public Work Wage Investigators enforce the provisions of the Labor Law governing wage rates, including prevailing supplemental rates paid for fringe benefits, and other conditions of employment for workers employed on public work projects.  They inspect employer records and interview employees and conduct surveys to determine the prevailing wage rate in specific localities. Compliance is sought primarily through educative means rather than prosecution. The duties require a general knowledge of the policies, rules and regulations of the Labor Department and a thorough knowledge of the provisions of the specific laws involved.

 

PUBLIC WORK WAGE INVESTIGATOR makes field investigations in an assigned area to assure the application and enforcement of the provisions of the Labor Law with respect to wages, fringe benefits, discrimination and other conditions of employment on public construction projects, and gathers data on wage rates and on the kind, extent and value of fringe benefits prevailing for workers employed on public work projects in a given area: confers with and advises contractors and public officials planning or engaged in public construction work, on all aspects of the pertinent provisions of the Labor Law; interviews employers and employees, inspects payrolls and time records and analyzes jobs for proper classification to determine whether legal requirements as to wage rates, payment practices, hours of work, citizenship, residence, and non-discriminating practices in employment are met; investigates specific complaints of violations; negotiates terms of settlement of underpayment of wages or other irregularities, and evaluates requests for exceptions to regulations regarding overtime hours because of hardship or other causes; writes reports and recommendations and issues orders to effect com­pliance. QUALIFICATIONS: Four years of satisfactory experience in building, highway, or heavy engineering construction, preferably on diversified types of construction requiring a knowledge of duties and classification of the various crafts employed. Training equivalent to an apprenticeship in a recognized craft related to construction, will be accepted in lieu of experience on a year-for-year basis. Technical institute or college training with appropriate specialization will be accepted in lieu of experience, on a year-for-year basis, up to a maximum of two years.

 

SENIOR PUBLIC WORK WAGE INVESTIGATOR, under general supervision, super­vises the application and enforcement of provisions of the Labor Law relating to hours of work, wages, fringe benefits and conditions of employment on public construction projects in an assigned area of the state: analyzes data on wages and fringe benefits and proposes minimum wage rates; assigns work to investigators, assists them in more difficult investigations and reviews their reports; maintains production reports and records of jurisdictions and projects liable under the law; maintains liaison with organized labor in the building trades in the area super­vised; and maintains the good will of public officials and advises them on the requirements of the law. QUALIFICATIONS: One year of permanent service as a Public Work Wage Investigator.

 

SUPERVISING PUBLIC WORK WAGE INVESTIGATOR directs the field activities of the Bureau of Public Work throughout the state and coordinates field services in the various area offices, or serves as assistant to the Director Public Work Wage Investigation in the Albany office of the Bureau. As field supervisor, assigns and reassigns field staff; reviews field methods and procedures with a view to assuring uniform application of standards, and evaluates workload reports; confers with various interested parties on matters which cannot be settled on a lower level; conducts hearing on violations having statewide significance. As assistant to the Director Public Work Wage Investigation, directs office services, determines personnel, equipment and material requirements, and prepares the Bureau's budget request and justification; establishes and maintains materials to insure efficient operation and office management; orders surveys and establishes the prevailing rates for all locations throughout the State and approves the issuance of dispensations; directs the work of the investigative staff in the Albany district; maintains liaison with other units of the department. QUALIFICATIONS: One year of permanent service as a Senior Public Work Wage Investigator.

 

DIRECTOR PUBLIC WORK WAGE INVESTIGATION plans and directs the program and activities of the Bureau of Public Work: supervises the department's program of enforcing the requirement that workers employed on public work projects receive the prevailing wage for their craft and of placing all contractors at the same competitive level when bidding on public work contracts; coordinates field and office services; coordinates the work of the Bureau with other parts of the depart­ment and with other agencies of the state; confers with employees, contractors and representatives of employees or employers in matters not resolved on a lower level; reviews the reports of hearings held by area supervisors and conducts hearings on violations having Statewide significance; proposes legislation in connection with the sections of the Labor Law dealing with public work. QUALIFICATIONS: One year of permanent service as a Supervising Public Work Wage Investigator.
