The Five-Year Provisional Reduction Plan

The State Civil Service Commission at its June 10, 2008 meeting, heard presentations pertaining to the proposed five-year plan submitted by the New York City Department of Citywide Administrative Services (DCAS) pursuant to Section 65 of the New York State Civil Service Law. The State Civil Service Commission is to determine whether the plan provides a timely and practicable implementation schedule in order to reduce the number of New York City provisional employees within the five years of the plan. After a review of the plan, and in consideration of comments at the meeting, the Commission determined that additional documentation and explanation is needed prior to acting on the plan.

Various parties submitted objections to the Plan. Over two-hundred signed petitions in objection were also received; each individual name has been included as part of the official record.

The State Civil Service Commission is not at this time reviewing the merits of any of the proposed jurisdictional classifications in the DCAS plan. Approval of the plan is not approval of the proposed jurisdictional reclassifications that it contains. Each request for jurisdictional classification of a position outside of the competitive class must go through the required approval process, which includes a public hearing prior to its submission to the State Civil Service Commission for review. The Commission will review each request submitted by DCAS and render a determination based upon the facts and documentation supporting the particular request.

The DCAS plan was submitted to the State Civil Service Commission on March 28, 2008 and the Commission requested additional supporting documentation and explanation on June 11, 2008. DCAS submitted that additional information to the Commission on August 8, 2008. The Commission heard presentations on the content of the additional documentation and explanation at its September 16, 2008 meeting.

At that meeting, the Commission approved the Plan with recommended changes. Below is a link to the full Commission decision.
