Minimum Qualifications

On or before May 17, 2014, you must be a qualified employee of New York State and have had three months of permanent competitive or 55-b/55-c service as follows:

For Number 37-065:

Either A. as a Senior Personnel Administrator, Personnel Administrator Trainee 2, or Personnel Administrator Trainee 1;
Or B. as a Legal Assistant 2.

For Number 37-066:

Either A. as an Agency Labor Relations Representative 1;
Or B. as an Associate Personnel Administrator or Administrative Officer 1.

For Number 36-067:

Either A. as an Agency Labor Relations Representative 2 or Agency Labor Relations Representative 1;
Or B. as a Director of Personnel D, Assistant Director Personnel B, Director Institutional Human Resources Management 1, Associate Personnel Administrator, Administrative Officer 1, Administrative Officer 2, or Director Human Resources Management 1.

If you were permanently appointed to a qualifying title on or before February 17, 2014, and have served continuously in this title since that date, you are eligible to file for this examination.

Vacancies are anticipated which may include Spanish language positions. The eligible lists resulting from these examinations will be used to fill these positions. Eligible list candidates for these positions must demonstrate proficiency in the Spanish language at a level that will assure there ability to perform properly the duties of the positions.

Qualifying Experience for Appointment from the Eligible List

After one year of service at the full performance level as described in the minimum qualifications, successful candidates will be qualified for appointment from the eligible lists.

Subject of Examination

The examination consists of a written test that you must pass in order to be considered for appointment. The written test will be held on May 17, 2014 (or May 18, 2014) and June 7, 2014. Candidates are required to participate on both test dates. The written test is designed to test for knowledge, skills, and/or abilities in such areas as: For Examination Numbers

Subject areas to be held on May 17, 2014 (or May 18, 2014):
1. Analyzing and evaluating information - These questions will test for the ability to analyze, interpret, and draw reasonable conclusions from information presented in text, data, images, or symbols. Analysis may involve identifying a significant problem or issue; focusing on relevant data and text; identifying trends, relationships, and significant features; assessing relevant alternatives; suggesting or evaluating possible conclusions; and applying logical principles to information provided. 2. Written expression - These questions test for the writing skills used in composing memos, reports and correspondence, as well as in reviewing documents produced by others. Both sentence skills and paragraph skills are addressed. The specific points tested include grammar, usage, punctuation, sentence structure, appropriate and correct content, editing, and organizing sentences into well-constructed paragraphs. X X X
3. Supervision - These questions test for the knowledge of the principles and practices employed in planning, organizing, and controlling the activities of a work unit toward predetermined objectives. The concepts covered, usually in a situational question format, include such topics as assigning and reviewing work; evaluating performance; maintaining work standards; motivating and developing subordinates; implementing procedural change; increasing efficiency; and dealing with work-related problems, including problems of absenteeism, morale, and discipline. 4. Administrative supervision and management - These questions test for the knowledge of the principles and practices involved in providing supervision to subordinate supervisors and indirect supervision to their unit staff. Questions related to the effective management of work will also be included. Questions will cover such areas as assigning work to and coordinating the activities of several units; planning, implementing, and evaluating work initiatives; determining relative priorities of work assignments, issues and problems; establishing and guiding staff development programs; designing and implementing action plans; evaluating the performance of subordinate supervisors; and maintaining relationships with other organizational sections.   X X

1. Management and administration of an agency labor relations program - These questions test for knowledge needed to manage and administer an agency labor relations program, focusing on aspects such as staffing considerations; legal requirements; administering collective bargaining agreements and negotiating local agreements; and administering disciplinary programs. The questions will cover areas such as transfers; appointments/terminations; employee performance management; equal employment opportunity; the Americans with Disabilities Act (ADA); Public Officers Law; attendance and leave; the Family and Medical Leave Act (FMLA); the Fair Labor Standards Act (FLSA); the Taylor Law; New York State Civil Service Law; negotiated agreements; grievances; disciplinary procedures; interpreting and analyzing bargaining agreements and advising management of the result; managing meetings; presenting proposals; responding to demands; reaching a compromise; negotiating agreements; ensuring agreed upon terms are met; investigating employee misconduct and incompetence; gathering and analyzing information; conducting interviews and interrogations; recommending appropriate action; preparing notices of discipline; advocating the State���s position at hearings and arbitration; and negotiating settlements. Logical reasoning - These questions will test for the ability to reason logically by interpreting statements in an accurate and reasonable manner; identifying the logical relationships between related statements; determining the conclusions that can correctly be drawn as a result of information presented; distinguishing between relevant and irrelevant information; and applying logical principles to information provided. If you pass, your seniority credit(s), if any, will be included in the computation of your final score. Rank on the eligible list will be determined after adding any wartime veterans' credits to your final passing score.

Credit for Seniority

Seniority is credited at the rate of one credit for each five-year period (or fraction thereof), excluding the first year of service.

Duties

Agency Labor Relations Representatives develop, coordinate, and maintain the labor relations program of a State agency. They administer employee discipline and grievance procedures; participate in negotiations with employee representatives; work with labor/management committees; and provide technical advice and assistance to agency management in implementing negotiated contracts and maintaining effective labor relations.

NOTE: Appointments to positions in some State agencies require candidates to undergo an investigative screening. This may include a thorough character investigation, a Federal Bureau of Investigations Criminal Record History Check, a Child Abuse Registry clearance, or other similar procedures. Candidates may be fingerprinted and may be required to pay any necessary fees for that procedure. Depending on the nature of the job, the criminal convictions discovered, or any falsified or omitted information revealed, the investigative finding may bar appointment or result in removal after appointment.

Admission to Examination

Notice to appear for the test may be conditional as review of applications may not be made until after the test. Multiple Examinations Scheduled for the Same Day

If you have applied to take a written test announced by either one or several local jurisdictions (county, town, city) scheduled to be held on the same test date as this written test, you must notify each of the local jurisdictions no later than two weeks before the test date to make arrangements for taking all tests at one test site. All tests will be held at the state examination center. Eligibility for Examination

To be eligible to compete in this examination, you must be employed in the specified department or agency on a permanent or contingent permanent basis in the competitive class, or in the non-competitive class or labor class if specifically noted on this announcement (or be on an appropriate preferred list), and have the specified time in the specified title or salary grade. You may not compete in a test for a title if you are permanently employed in that title (unless you are still on probation) or in a higher direct line of promotion.

Cell Phones or Electronic/Communication Devices at the Test Site

Do not bring cell phones, beepers, headphones, or any electronic or other communication devices to the test site. The use of such devices at the test site in the test room, hallways, restrooms, building, grounds, or other areas could result in your disqualification.
