Job Description

As a Health Hearing Examiner you will preside at Department of Health adjudicatory hearings related to various provisions of Public Health Law, Social Services Law, and State and federal codes, rules, and/or regulations and evaluate testimony and other evidence, rule on motions, draft legal decisions, and issue final decisions for various hearings and hearing appeals in DOH's Division of Legal Affairs. Positions/incumbents moderate hearings to maintain an orderly examination of issues; hear arguments presented by parties; evaluate and considers the appropriateness of testimony and other evidence presented; rule on legal motions; and ensure that hearings are transcribed.

Minimum Qualifications

You must meet the requirements below to qualify for this title.

Admission to the New York State Bar, and five years of subsequent legal experience, including either one year as a presiding hearing officer in patient care, enforcement and disciplinary hearings against professionals, eligibility hearings, Social Security or Medicaid; or two years as the attorney of record in administrative proceedings involving patient care, enforcement and disciplinary hearings against professionals, eligibility hearings, Social Security or Medicaid; or one year as a judge in the unified court system.

Additional Requirements for Appointment

Experience gained subsequent to admission to the Bar in a state having reciprocity with New York State can be credited only after admission to the New York State Bar. Candidates must note such experience and the existence of the admission reciprocity agreement at the time of interview.
