ISSUE:
Determine if a new enrollee waiting period should apply to employees of local entities acquired by State agencies assuming the responsibilities of the local agency.
Background:
A State agency acquired a number of employees when it took over the functions of the local agency. The State agency wished to grant those employees coverage as of the first day of State employment. While there was precedent for such an action, no formal policy existed.
Policy:
Employees of an acquired local entity (public or private) will be allowed to begin NYSHIP enrollment on the first day of State employment if they have satisfied a period of employment with the local agency equivalent to the new enrollee waiting period as of that date. If an employee has not satisfied the waiting period with the local entity, then the remaining days must be satisfied under State employment.
