ISSUE:

Determine if individuals absent under the Family Medical Leave Act (FMLA) are eligible for a waiver of premium.

Background:

The question was raised as to whether an enrollee could apply for a waiver of premium while on FMLA leave because FMLA-entitled enrollees pay only the enrollee share of premium. Except for individuals in preferred list status, waivers of premium are restricted to enrollees paying full share while on leave without pay.

Policy:

Allow enrollees absent on FMLA leave due to their own illnesses to apply for a waiver of premium if they are otherwise eligible.
