Subject: Termination Date for Remarried Dependent Survivors
PURPOSE:
Determine the effective date of termination of coverage when it is discovered that a dependent survivor has newly married or entered into a new domestic partnership.
BACKGROUND
Section 165.2 of the Civil Service Law states that only the “unremarried spouse” of an employee covered at the time of the employee’s death is eligible for continued coverage.
POLICY
NYSHIP dependent survivor coverage will terminate on the date that the Employee Benefits Division is notified of the dependent survivor’s new marriage. This applies to both spouses and domestic partners enrolled as dependent survivors. In addition, NYSHIP dependent survivor coverage will terminate on the date that the Employee Benefits Division is notified that the domestic partner has entered into a new domestic partnership.
