ISSUE:
Application of waiting period for an employee whose employment is reinstated retroactive to the date of termination.
Background:
A unionized employee left her position with the State and was reinstated six months later; she wished to re-enroll in the Program without a waiting period. Policy Memo #6 (Rev.6/2/87) established the policy for employees who are terminated and reemployed during a period of continuation of coverage. Policy Memo #6 did not address the question of a person who is reinstated retroactively to the date of termination.
Policy:
If a person is reinstated to State service retroactive to the date of termination, no waiting period must be satisfied.
