SUBJECT: Sick Leave Adjustment for former APSU employees

One of the provisions contained in the recent 2011-2015 Agreement between the State of New York and the PBANYS for employees in the APSU, formerly known as Agency Law Enforcement Services Unit, included retroactive salary adjustments. As a result of this provision, employees who retired between April 1, 2005 and March 31, 2012, may be entitled to an increase in their monthly sick leave credit based upon the retroactive salary increase, which in turn results in an adjusted hourly rate of pay at the time of retirement.
Using NYBEAS, we have identified enrollees who are potentially eligible for an adjustment of their sick leave credit. This identification was based upon employees currently enrolled with retiree benefits, who last worked for the State on or after April 1, 2005, and were designated negotiating unit 31 at the time they last worked for the State.
The attached listing represents the identified retirees from your agency and their current monthly sick leave value. Please review the listing and determine if any sick leave adjustments are necessary. If sick leave credit amounts need to be recalculated, note the new rate of pay on the enclosed listing and return it to the Employee Benefits Division, along with a signed cover letter authorizing the change. If your agency has already contacted the Employee Benefits Division (EBD) to update the sick leave information for your employees, no additional action is necessary. To verify that EBD has received and processed this information, you can review the enrollee’s sick leave status on the NYBEAS Sick Leave History panel.
Enrollees whose have deferred their coverage, are currently covered under a spouse/domestic partner or who voluntarily cancelled their coverage will not be included on this list, but may also need updated sick leave information provided to them. We recommend that you provide these enrollees with an updated PS 410 sick leave preservation form
